Our client received a Minded to Bar letter from the DBS after allegations from a work colleague that the client used inappropriate language in the workplace in front of a vulnerable person. The DBS letter asserted, amongst other things, that the language was discriminatory and homophobic and that there was potential for emotional harm to vulnerable adults.
Our submissions concentrated on showing that any words used by our client were merely an isolated lapse and that the reasoning put forward in the Minded to Bar letter was vague and speculative, and that this was just a workplace disagreement.
The DBS closed the case without further action.
