GPhC – Allegations of Unauthorised Medication Supply and Interim Order Application Resulting in No Restrictions

A registered pharmacist appeared before the Fitness to Practise Committee of the General Pharmaceutical Council (GPhC) following an interim order application. The regulator alleged that the pharmacist had supplied medication to an acquaintance, who then administered them to a third party without her knowledge or consent, resulting in a harm. The concerns were based on reports from the third party’s family, text message evidence, and the acquaintance’s subsequent departure from the country to avoid police investigation.

The GPhC submitted that these allegations, if substantiated, posed a significant risk to patient safety and public confidence in the profession, and sought an interim suspension order.

The pharmacist was represented by counsel instructed by Regulation Resolution Solicitors. The defence strategy focused on demonstrating that the evidence presented was not sufficiently cogent or reliable to justify any interim restriction. Submissions highlighted the lack of direct evidence linking the registrant to the alleged supply, inconsistencies in the accounts provided by the third party’s family, and the absence of any immediate risk to patient safety. The registrant’s ongoing cooperation with the investigation and positive evidence regarding their current practice were also emphasised.

The panel carefully reviewed the evidence before it. It concluded that the concerns were not supported by sufficiently compelling evidence and that imposing an interim order would be disproportionate in the circumstances.

No interim order was imposed. The registrant was permitted to continue practising without restriction pending further investigation.

What this means if you’re facing similar allegations

An interim order is only justified where the evidence is sufficiently cogent and a real risk exists. Highlighting the absence of direct evidence, inconsistencies in the accounts, and your ongoing cooperation can show that an interim restriction would be disproportionate.
