Decision on Further Action
After the completion of an NMC investigation, the case examiners carefully assess the gathered evidence to determine whether there is a case to answer. If they find that a case exists, it will proceed to a fitness to practise hearing. However, if the case examiners conclude that there is no case to answer, the matter may be closed.
Fitness to Practise Hearing
Should the case proceed to a hearing, a panel is convened, consisting of both healthcare professionals and lay members. This diverse panel ensures a comprehensive evaluation of the case. During the hearing, evidence is presented, allowing the nurse or midwife an opportunity to defend themselves. The panel, after considering the evidence, makes a crucial determination regarding the nurse or midwife’s fitness to practise. If impairment is identified, the panel decides on the appropriate action to be taken.
Possible Outcomes:
The outcomes of a fitness to practise hearing can vary based on the panel’s assessment. Potential outcomes include:
No further action: If the panel determines that the nurse or midwife’s fitness to practise is not impaired.
Caution or advice: A less severe measure indicating a need for guidance or improvement.
-Conditions of practice: Imposing specific conditions to ensure safe and competent practice.
– Suspension: Temporarily removing the nurse or midwife from practice.
– Removal from the NMC register: The most severe outcome, indicating a permanent removal from the professional register.
Appeals:
Both the nurse or midwife and the NMC retain the right to appeal the decision of the fitness to practise panel. However, there are strict and very limited timeframes for initiating this process.
Review:
In cases where a nurse or midwife is subject to conditions of practice or suspension, periodic reviews are conducted. These reviews assess the individual’s progress and determine whether they are fit to return to unrestricted practice.
